How Long Do I Have to File a Personal Injury Claim in Missouri?

How long an injured individual has to file a personal injury claim is determined by a law called the statute of limitations. According to the Missouri Code section 516.120, the statute of limitations for personal injury cases in the state of Missouri is five years.

More specifically, this means you have five years from the date your injury occurred to file, or you risk losing your right to file and pursue compensation. It’s important to note that there are exceptions that can change this five-year time limit.

Some examples of these exceptions include:

  • If the injury victim was under the age of 21 when the accident happened
  • If the injury victim has a condition that qualifies them as mentally incapacitated
  • If the alleged negligent party leaves the state before a claim can be filed

The statute of limitations has a big impact on your ability to file a claim so it’s crucial to speak to an experienced Newton County personal injury attorney about the specifics of your case as soon as you can. Neff & Day, P.C. offers free, no-obligation consultations so you have nothing to lose by contacting our firm today!
